Thailand Condominium Purchase Law

Background

Pursuant to Thailand condominium law, non-Thai nationals may, in general, purchase condo units in condominium buildings as long as their purchase would not cause the total foreign ownership ratio of combined units in the building to exceed 49% of the total floor area.

As a result, foreigners have a much simpler and more direct procedure to acquire condo ownership in Thailand as when compared to acquiring land rights. Condominium units are popular with foreign expatriates, Thai nationals and persons seeking investment property.

Condominium transactions will normally require a due diligence on the condo unite, the juristic person, and the seller. Additional precautions include a well-written sales purchase contract and a licensed attorney to supervise the transfer.
