US Immigration from Thailand: Fiancée Visa for Thai Fiancée
Background
The K-1 Fiancée/Fiancé Visa is a 90 day single-entry visa that allows the Thai fiancée/fiancé of an American citizen to enter the United States with the intention of getting married during this period. If the marriage does not take place, the fiancée/fiancé is required to return to their home country.
The advantage provided by a Fiancée Visa is to allow an engaged couple prepare for marriage and residing together in the U.S.A. as a married couple. If the relationship does not work out, or the couple find life as a married couple in the U.S.A. is not what they want, the K-1 Fiancée Visa allows the couple to "test the waters" for a period of 90 days in the U.S.A. Another advantage of a K1 Fiancée Visa is that it is generally faster, simpler and less expensive than a marriage visa.
The disadvantage of a K1 Fiancee Visa is that if and when the couple does move and the foreign spouse decides to immigrate and reside in the U.S.A., there is more paperwork, delay and expense involved than had they originally filed for a Marriage Visa (immediate relative petition).
